Трансформація карцеральних практик Пенсильванії: від Зводу законів В. Пенна до пенітенціарного будинку у Walnut Street Prison

У статті проаналізовано трансформацію карцеральних практик у Пенсильванії (1682–1790 рр.) у контексті змін кримінальних законів: від формального закріплення у Зводі законів 1682 р. виправних будинків з примусовою працею до організації у Філадельфії 1790 р. першого пенітенціарного будинку з режимом суворого одиночного утримання.
Визначено, що до здобуття штатами незалежності виправні будинки, якщо і функціонували в окремих містах, то як заклади примусової праці й мета виправлення перед ними не стояла. Вирішальний вплив на реформу системи покарань мали революційні події війни за незалежність, у наслідок чого ухвалено конституцію штату, що містила припис переглянути системи покарань. Ухвалений 1786 р. кримінальний закон основною санкцією за більшість тяжких злочинів встановив тюремне ув’язнення у поєднанні з каторжними роботами, але режим ув’язнення жодним чином не змінився, а публічні каторжні роботи визнані були неефективними як з точки зору безпеки, так і виправного впливу.
Встановлено, що основними акторами подальших пошуків моделі відбування покарання у виді позбавлення волі були члени Філадельфійського товариства полегшення страждань у в’язницях. Основні кроки реформаторів у 1788–1790 рр. спрямовані на впровадження на основі практичного досвіду виправних будинків Англії та теорії тюрем законодавчих змін у сфері виконання покарань з акцентом на одиночному утриманні. 1790 року ухвалено закон, у якому основними елементами режиму відбування покарання визначено каторжні роботи й сувору ізоляцію з метою виправлення злочинців і запобіганню нових злочинів, для чого приписувалося звести у дворі Walnut Street Prison окремий корпус з одиночними камерами для утримання небезпечних злочинців. Закон встановив механізм контролю й нагляду за діяльністю в’язниці, а також унормував режимні засади відбування покарання, що були багато в чому запозичені з досвіду англійських виправних будинків.
